Jeff Fassett: Wyoming state law recognizes that water in the streams can be considered a beneficial use

Our priorities are really to follow the State's laws to allow the citizens, the water users, who want to make beneficial use of water to come forth and to apply for the water rights. In the state of Wyoming, it is the State Engineer who makes the decision to approve or reject those water rights applications.
